Welcome to Primalist (the “Site”), operated by Maxselle Media Inc. (“Primalist”, “we”, “us”, “our”).
These Terms & Conditions (“Terms”) explain how you may use our website, courses, programs, community spaces, and digital products (together, the “Services”).
By using the Site, creating an account, or purchasing anything from us, you agree to these Terms.
If you do not agree, please do not use the Site or Services.
1. Who we are

“You”, “your”, and “user” mean anyone who visits the Site, creates an account, or uses our Services.
2. What we offer
We provide educational and informational content and services, including:

Online courses and programs (hosted via an LMS, e.g., TutorLMS)

Membership / community access (private online communities and/or platform-based groups)

Digital products and downloads (e.g., PDFs, frameworks, tools, audio/video)
We may also offer now or in the future:

Live group calls or workshops (online sessions)

1:1 coaching or consulting (online sessions)
We may add, change, or remove Services at any time.
Unless we clearly state otherwise, everything we provide is for educational and informational purposes only, not professional medical, mental health, legal, or financial services.
3. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page.
If the changes are important, we may also notify you by email or a notice on the Site.
If you keep using the Services after changes are posted, you are agreeing to the updated Terms.
4. Eligibility & age requirements
Our Services are designed primarily for adults.

You must be at least 18 years old (or the age of majority in your region) to:

Purchase paid products, or
-
Create an account in your own name and agree to these Terms yourself.

If you are between 13 and 17 years old, you may only use the Services:

With the consent and supervision of a parent or legal guardian, and

That parent or guardian is the one entering into these Terms on your behalf and is responsible for your use of the Services.

Our Services are not directed to children under 13.
We do not knowingly collect personal information from children under 13.
If we become aware that we have personal data for a child under 13, we will delete it.
You are responsible for making sure that the information you provide is accurate and kept up to date.
5. Accounts and security
You may need an account to access certain parts of the Services (for example, courses or community areas).
You can create an account by:

Using your email and a password, or
-
Using social logins (e.g., Google, Facebook), when available.
You are responsible for:

Keeping your login details confidential, and
-
All activity that happens under your account.
If you believe your account has been compromised, please email hello@primalist.com as soon as possible.
We may suspend or terminate your account if we reasonably believe you have violated these Terms or misused the Services.
6. Payments, pricing, and billing
6.1 Currency & pricing

Unless stated otherwise, all prices are listed in US Dollars (USD).

We sell our products and services worldwide.

You are responsible for any taxes, fees, or charges applicable in your country or region.
We may change our prices at any time. Price changes do not affect purchases you have already completed.
6.2 Payment methods
Payments are processed securely through third-party payment processors, such as:

Stripe, including options like Apple Pay (where available)

Possibly other payment methods in the future (e.g., Klarna for payment plans)
When you provide payment information, you confirm that:

You are authorized to use the payment method, and
-
You authorize us and/or our payment providers to charge the full amount shown at checkout, including any applicable taxes.
6.3 Subscriptions & auto-renewal
Some Services (such as memberships or subscription-based courses) may be offered as recurring subscriptions (for example, monthly).

If you subscribe, your subscription will automatically renew at the end of each billing period, using the same payment method, until you cancel.

You can cancel future renewals at any time through your account settings or by contacting us at hello@primalist.com.

When you cancel, your access continues until the end of the current paid billing period.
After that, access ends and no further charges occur, unless you resubscribe.
6.4 Payment plans
For some higher-priced products, we may offer installment or payment plans (e.g., multiple monthly payments via Stripe or Klarna).

When you choose a payment plan, you agree to complete all scheduled payments.

If a payment fails or is not completed:
-
We may suspend or revoke your access to the product or Service until the payment is successful.

If the payment issue is not resolved, we may cancel your access permanently.

6.5 Chargebacks
If you dispute a charge directly with your bank or payment provider (a chargeback) instead of contacting us:

We may revoke access to the products or Services associated with that payment, and
-
We may ban you from future purchases at our discretion.

7. Refunds and cancellations
We want our products to deliver real value. At the same time, we need clear rules so everyone knows what to expect.
7.1 General 30-day refund policy (courses, programs, digital products)
For most digital products, courses, and programs purchased directly from Primalist:

We offer a 30-day refund period from the date of purchase,
-
No questions asked. You can request a refund for any reason if you are within this 30-day window.
This applies to:

One-time purchase courses and programs
-
One-time purchase digital downloads and products
To request a refund, email hello@primalist.com with:

Your full name
-
The email address used for purchase
-
The product or program name
-
Your order receipt or transaction details (if available)
We may process refunds only to the original payment method used.
7.2 Subscription refunds
For subscription-based products (such as a membership or subscription course):

You may request a refund for the first billing period within 30 days of your initial subscription payment.
-
After the first billing period:
-
Refunds are not available for renewal payments,
-
But you may cancel at any time to stop future charges,
-
You keep access until the end of the current paid period.
-
7.3 1:1 coaching and consulting (non-refundable, time-based)
For 1:1 coaching or consulting sessions, including packages:
-
These are generally non-refundable, because we reserve time specifically for you.
-
However:
-
If you cancel at least 48 hours before the scheduled session, we will refund 100% of the fee for that session.
-
If you cancel between 24 and 48 hours before the session, we will refund 50% of that session fee.
-
If you cancel less than 24 hours before the session, or do not show up for the session, no refund will be given.
-
We may choose, at our discretion, to reschedule rather than refund in some cases, but we are not required to do so.
7.4 Live group calls & workshops (now or future)
For standalone live group calls or workshops (not part of a subscription or course), specific refund terms may be listed on the checkout page or event description.

If no special terms are stated, the default is:
-
You may request a refund within 30 days of purchase and before the main live event has taken place,
-
No refunds will be given after the live event has occurred.
-
7.5 Abuse of refund policy
If we suspect that someone is abusing our refund policy (e.g., repeatedly buying, downloading everything, then refunding), we may:
-
Refuse future refunds, and/or
-
Deny access to future products or Services.
7.6 Community bans and refunds
If a user seriously violates our community rules (for example, hate speech or harassment):

We reserve the right to ban them from the community and/or Services, and
-
We may choose to provide a refund for the current product/period and then permanently end access.
-
We are under no obligation to continue serving users who behave abusively or in bad faith.
8. Access, “lifetime” and changes to content
When you purchase a one-time course or digital product that includes “lifetime access”:

“Lifetime access” means the lifetime of that course or product, or the lifetime of the platform on which it is hosted, not your personal lifetime.

We may update, move, or retire content as our business evolves, but we will act reasonably and in good faith.
We may, at any time:

Add, update, or remove lessons or modules within a course,
-
Change how content is organized or delivered,
-
Move to another learning platform or technology.
We are not obligated to maintain specific content or features forever.
9. Acceptable use and community rules
You agree not to use the Site or Services to:

Break any local, national, or international laws or regulations,
-
Harass, threaten, abuse, or harm others,
-
Post or share hateful, racist, sexist, discriminatory, or extremist content,
-
Share explicit pornographic or sexually explicit content,
-
Promote illegal activities or violence,
-
Share or encourage self-harm or harm to others,
-
Doxx, stalk, or invade the privacy of any person,
-
Spread spam, advertisements, or unapproved self-promotion,
-
Upload or distribute viruses, malware, or harmful code,
-
Use bots, scrapers, or other automated methods to copy or access the Services beyond normal use,
-
Infringe on any intellectual property or other rights of Primalist or any third party.
We may host communities on our own site or on third-party platforms (e.g., Discord, Facebook groups, WhatsApp, etc.).
You must also follow the rules of those platforms.
If we believe you are violating these rules, we may:

Remove or edit your content,
-
Suspend or terminate your access to some or all Services,
-
Ban you from future participation.
We may, at our discretion, also issue refunds and permanently end the relationship.
10. User content and testimonials
10.1 User content
“User content” includes anything you share or upload via our Services, such as:

Comments, posts, messages, or responses in communities or forums,
-
Homework, assignments, shared documents, or uploads,
-
Feedback you send us directly (email, forms, messages).
You keep ownership of your user content.
However, by posting or submitting content to our Services, you grant us a worldwide, non-exclusive, royalty-free license to:

Use, display, reproduce, and share your content as part of operating, improving, and promoting the Services.
For private community content, we will:

Use identifiable content (e.g., your name, photo, voice) in public marketing only with your explicit permission, and

We may quote or reference posts anonymously or in aggregated form (e.g., “Someone in the community shared…” or “Many members have experienced…”).
You are responsible for making sure your user content:

Does not violate any law or third-party rights,
-
Complies with the community and acceptable use rules above.
We may remove user content at our discretion if we believe it violates these Terms or is harmful.
10.2 Testimonials and success stories
If you voluntarily send us a testimonial, review, or success story (for example, via email, form, interview, or recorded video), and clearly intend it as feedback we may share, you grant us permission to:

Use it for marketing and promotional purposes (on our website, emails, social media, sales pages, etc.),
-
Use your first name and last initial, city, and/or country, unless you request anonymity,
-
Edit it for length and clarity, without changing its overall meaning.
If at any point you wish for a testimonial to be removed from public use, you may contact us at hello@primalist.com and we will act reasonably to address your request.
11. Intellectual property
Unless otherwise stated, all content in our Services is owned or licensed by Maxselle Media Inc. and/or its licensors, including:

Course videos and audio,

Text lessons, frameworks, and written materials,

PDFs, downloads, workbooks, and tools,

Logos, trademarks, branding, and design,
-
Website design and structure.
When you purchase access, you are granted a personal, limited, non-exclusive, non-transferable, revocable license to access and use the content for your own personal, non-commercial use only.
You may not:

Copy, reproduce, share, or distribute our content to others,

Upload our content to other websites or platforms,
-
Resell or commercially exploit our materials,
-
Claim our content as your own, or create derivative products from it.
If you want to use any of our materials for commercial purposes (e.g., in your own business, coaching, or training), you must obtain prior written permission from us.
12. Third-party tools and services
We use various third-party services to operate and improve the Site and Services, including but not limited to:

Stripe (and related methods like Apple Pay) for payment processing,

Google Analytics and Google Search Console for analytics and performance,

Facebook and other social platforms for tracking, advertising, and social login,

Social login providers (e.g., Google, Facebook) for signing in,

Hosting, email, and other infrastructure providers.
These third parties have their own terms and privacy policies, which govern your use of their services.
We are not responsible for their content, policies, or practices.
The Site may also include links to other websites. We do not control those sites and are not responsible for their content. Using such links is at your own risk.
13. Educational purpose only – no professional advice
Our Services may cover areas including:

Mental health, depression, anxiety, and mindset

Fitness, training, and physical performance

Money, career, and business

Relationships, dating, marriage, sex, and family

Purpose, meaning, and worldview

We give you tools and guidance, but you alone are responsible for how you use them and the results you get. We are here to support you as best as we can, but we cannot guarantee outcomes.
14. Safety, crisis, and physical risk
14.1 Crisis and emergencies
Primalist is not designed for emergencies or crisis situations.
If you are in immediate danger, having thoughts of self-harm, or considering harming others, you must:

Contact your local emergency services, crisis hotline, or qualified professional right away.

Do not rely on Primalist, our content, or our community for emergency support.
14.2 Physical activity and injury
Some of our content may involve exercise, training, or physical activity.
You understand that:

All physical activity carries some risk of injury or health issues,

You are responsible for evaluating your own physical condition and limitations.
You should:

By choosing to follow any exercise or health-related content from Primalist, you do so voluntarily and at your own risk.
We are not responsible for injuries, health problems, or other consequences that may result.
15. No guarantees of results
We design our content and programs to help you improve your life, health, relationships, mindset, and other areas. Many people may experience positive changes from applying the material.
However, we do not guarantee that:

You will achieve any specific results (e.g., a certain amount of weight loss, income, relationship outcome, or mental state),

You will reach those results within a specific timeframe.
Your results depend on many factors, including:

Your effort and consistency,

Your starting point and circumstances,

Your health, environment, and relationships,

External factors beyond our control.
Any examples, testimonials, or case studies we share are for illustration only and do not guarantee that you will have the same experience.
16. Limitation of liability (strong protection)
To the fullest extent allowed by law:

We (Maxselle Media Inc., Primalist, and our directors, officers, employees, contractors, and partners) are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Our total liability for any claim related to the Site or Services is limited to:

You agree to indemnify and hold harmless Maxselle Media Inc. (Primalist), and our directors, officers, employees, contractors, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your violation of any law or third-party rights,

In simple terms:
If your actions cause legal or financial problems for us, you agree to take responsibility for those consequences rather than passing them onto us.
18. Emails, communication, and marketing
By creating an account, downloading a free resource, or making a purchase, you agree that we may contact you by email for:

We may also offer separate newsletter sign-up forms for people who have not yet purchased. These are opt-in and can be cancelled at any time.
19. Privacy and cookies
Your use of the Site and Services is also governed by our Privacy Policy (and any Cookie Policy, if applicable), which explains how we collect, use, and protect your personal information.

20. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising out of or relating to:

21. Termination

Intellectual Property, Disclaimers, Limitation of Liability, Indemnity, and Governing Law.
